Woman sues Cedar Point parent company after suffering serious head injury while waiting for Top Thrill Dragster

A woman who was injured by a metal bracket that broke off the Top Thrill Dragster at Cedar Point has filed a lawsuit against the park's parent company. The lawsuit alleges negligence and seeks compensation for serious injuries and medical expenses.

A woman who was struck by a metal bracket that broke off the Top Thrill Dragster at Cedar Point amusement park in Ohio has filed a lawsuit against the park's parent company, Cedar Fair. The lawsuit alleges that the park and Cedar Fair were negligent in installing and maintaining the ride, leading to the plaintiff's serious injuries. The lawsuit also claims that the park intentionally removed evidence related to the incident to hinder the plaintiffs' case.

The lawsuit was filed in Erie County's Common Pleas Court and includes the woman, her husband, and her father as plaintiffs. The incident occurred on August 15, 2021, while the woman was waiting in line for the ride. According to the lawsuit, she suffered significant injuries, including a traumatic brain injury, which will require lifelong care. The medical expenses incurred so far have exceeded $2 million, and future expenses are estimated to be over $10 million.

The woman's husband and father are also seeking compensation for the emotional distress they have experienced as a result of witnessing the incident. The lawsuit does not specify a specific amount of compensation sought but states that it should exceed $25,000.

The state's Amusement Ride Safety Division conducted an investigation into the incident and concluded that there was insufficient evidence to find any violations of state laws or regulations by Cedar Point. However, the lawsuit challenges this conclusion and holds the park and Cedar Fair accountable for the injuries sustained by the plaintiff.

Both Cedar Fair and Cedar Point have been contacted for comment, but Cedar Fair stated that they do not comment on pending litigation as a matter of company policy.

The Top Thrill Dragster, which had been in operation at Cedar Point for nearly 20 years, has been permanently closed. The park plans to introduce a "reimagined" version of the ride in the coming year.
